Brasilia, Brazil, February 20, 2015 – Currently under consideration in the House of Representatives the Law Project No. 16/2015 by deputy Otavio Leite (PSDB-RJ), which establishes rules for the licensing and operation of unmanned aerial vehicles (UAV) and remotely piloted aircraft, and drones entitled appliances.
The project comes to aerial vehicle designed to operate without a pilot on board, which has an embedded payload and is not used for purely recreational purposes. The definition includes airplanes, helicopters and blimps controllable in all three axes, excluding traditional balloons and model aircraft.
According to Leite, it is necessary to make clear that this issue should be under the full responsibility of the Ministry of Defense, through the Air Force Command, in particular the Department of Airspace Control (Decea).
Today, the use is regulated by the National Civil Aviation Agency (ANAC) and the Decea, but the design allows the department to delegate powers to the agency subsidiaries and complementary to the subject.
Prerogative – According to the proposal, the use of Vant and remotely piloted aircraft is private armed forces, the public security organs and intelligence, and other organs or public research entities. Exceptional cases will be admitted provided they follow the rules of the Law Project.
Under the Proposal, the Decea should evaluate the following criteria for licensing: the purpose of use incorporated into the National Defense Strategy, in particular in surveillance and monitoring of borders; respect for the inviolability of the right to privacy of citizens and property, including the right to capture images; research and scientific development, since if authorized by national academic body or supported by the Ministry of Science, Technology and Innovation (MCTI); the purpose of use for public safety operations, provided it does not jeopardize the population; prior measurement of professional fitness enabled to fly the UAV and remotely piloted aircraft.
The Air Force Command may deny authorization or order the suspension of activity or ongoing research with use of Vant whose action may cause vulnerability to national sovereignty and free competition or affecting unduly people's privacy.
The project will be reviewed by a special committee and then submitted to the plenary.
